These terms govern your use of the MortgageSocial platform (the “Service”), operated by Mortgage Social Pro Limited trading as MortgageSocial, a company registered in England &Wales (company number 05428597), whose registered office is at 12 Melbourne Business Court,Pride Park, Derby, England, DE24 8LZ (“we”, “us”, “our”). “You” means the firm or individual thatregisters for or uses the Service. By creating an account or using the Service, you agree to theseterms.The Service is provided for business use by professional firms only and is not a consumerservice.
2. Eligibility
You confirm that you are authorised and regulated by the Financial Conduct Authority (FCA), orare an appointed representative of an authorised firm, and that you hold the permissionsnecessary for the financial promotions you create and publish using the Service. You areresponsible for ensuring your continued authorisation
3. Your account
You must provide accurate registration information and keep your account secure. You areresponsible for all activity under your account. You must notify us promptly of any unauthoriseduse.
4. The Service
The Service provides tools to help you create, schedule and publish social media content foryour firm, including an AI assistant (“Mo”) that generates draft content, and connections to third-party social media platforms. We may add, change or remove features over time.
5. Subscriptions, fees and payment
Access to the Service requires a paid subscription. Our current plans and prices are shown onour pricing page at https://mortgagesocial.co.uk/pricing. Fees are billed in advance on a recurring basisthrough our payment processor, Stripe, and subscriptions renew automatically until cancelled.We may change prices on reasonable notice, with changes taking effect at your next renewal.Prices are exclusive of VAT unless stated otherwise.
You can cancel at any time. Cancellation takes effect at the end of your current billing month,and you keep full access until then. Fees already paid are not refunded, and we do not give pro-rata refunds for the remainder of a billing period, except where a refund is required by law.
6. Compliance checks and your responsibility
To assist you, the Service automatically reviews each post against the FCA’s financial promotionrules for mortgages (MCOB 3A) before it is shown to you. The check is designed to flag matterssuch as the required risk warning, your FCA disclosure, the absence of guarantee or false-urgency language, and fair wording around rates.
This automated check is an aid only. It is not a guarantee that a post is compliant, and it does notreplace your own review. You remain responsible for every post you approve and publish.

You remain solely and fully responsible for ensuring that allcontent you create, approve, schedule or publish using the Service complies with allapplicable laws and regulations, including the FCA’s financial promotion rules and therequirement that financial promotions are clear, fair and not misleading
Content produced by Mo is a draft aid only. It may be inaccurate, incomplete or unsuitable,and it is not regulatory, legal, financial or compliance advice.
You must review, edit as necessary, and approve every piece of content before it ispublished, applying your firm’s own compliance and financial-promotion approvalprocesses.
We do not review, approve or guarantee the compliance of any content, and we do not actas a compliance function for your firm.
7. Acceptable use
You must not use the Service unlawfully, infringe others’ rights, attempt to gain unauthorisedaccess, reverse engineer the Service, or use it to publish content that is false, misleading or inbreach of any platform’s rules
8. Connected third-party platforms
The Service can connect to third-party platforms (such as Meta/Instagram, Facebook, LinkedIn,X and TikTok) at your direction. Your use of those platforms is governed by their own terms, andyou are responsible for complying with them. We are not affiliated with, and do not control, thoseplatforms, and we are not responsible if a platform changes or withdraws access to its services.
9. AI-generated content
Content generated by Mo is provided “as is” and must be reviewed by you before use. You areresponsible for any content you choose to publish, and for ensuring you hold any rights neededto use it.
10. Intellectual property
We and our licensors own all intellectual property rights in the Service, including the platform andMo. We grant you a limited, non-exclusive, non-transferable licence to use the Service duringyour subscription. Content you create remains yours; you grant us the licence needed to hostand process it in order to provide the Service.
11. Availability and support
We use reasonable efforts to keep the Service available but do not guarantee uninterruptedaccess unless agreed in a separate service level agreement. We may carry out maintenance andwill aim to limit disruption
12. Limitation of liability
Nothing in these terms limits liability that cannot be limited by law (including for death or personalinjury caused by negligence, or for fraud)
Subject to that, we are not liable for indirect or consequential loss, loss of profit, business,goodwill or data; and our total liability arising out of or in connection with the Service is limited tothe fees you paid in the 12 months before the event giving rise to the claim.
In particular, we are not liable for any regulatory breach, penalty, complaint or loss arising from content that you reviewed, approved or published.
13. Warranties
The Service is provided “as is” and we make no warranties that it will be error-free or that anycontent it helps generate will be compliant, accurate or fit for a particular purpose.
14. Indemnity
You agree to indemnify us against claims, losses and costs arising from your breach of theseterms, your use of the Service, or the content you publish, including any regulatory action relatingto that content.
15. Data protection
Each party will comply with the UK GDPR and the Data Protection Act 2018. Our handling of personal data is described in our Privacy Policy.
16. Suspension and termination
We may suspend or terminate your access for material breach (including non-payment) or whererequired by law or by a connected platform. On termination, your right to use the Service ends;you will have a reasonable period to export your content where practicable.
17. Changes to these terms
We may update these terms from time to time. We will give reasonable notice of materialchanges, and your continued use of the Service after changes take effect constitutesacceptance
18. General
You may not assign these terms without our consent. These terms are the entire agreementbetween us regarding the Service. If any provision is unenforceable, the rest continue in force. Adelay in enforcing a term is not a waiver. A person who is not a party has no rights under theContracts (Rights of Third Parties) Act 1999.
19. Governing law
These terms are governed by the laws of England & Wales, and the courts of England & Wales have exclusive jurisdiction
